The client was driving his car when a bus attempted to make a left turn at an intersection onto the same street. The bus failed to ensure the intersection was safe from oncoming traffic and pulled out in front of the plaintiff’s vehicle and struck the front driver’s side of the car.
The defendant disputed liability, claiming the client failed to slow down and was looking toward his back passenger seat immediately before the collision.
The client suffered multiple serious injuries including a hip fracture, which required an emergency open reduction and internal fixation (ORIF). He had additional hip complications with joint infections that led to two additional debridement operations. The client subsequently experienced multiple hip dislocations, an unusual and challenging complication of his injury, that ultimately culminated in a hip replacement.
The severity of this collision goes beyond the client’s physical injuries. Following the accident, he was immobilized and required two-person assistance for all movement. He was unable to return to work for over a year and experiences significant limitations affecting his mobility and activities of daily living.
Recognizing the significance of the client’s ongoing medical needs, Attorney David Rabinowitz and the team hired an expert to opine the client’s anticipated future medical treatment.
The defendant initially offered $250,000 to resolve the claim. Through extensive advocacy on behalf of the client, Attorney David Rabinowitz successfully secured a $2.35 million recovery.
Attorney David Rabinowitz acknowledges,
“We developed a strong relationship and would often talk just about life. This settlement was fantastic in that it will truly help the client get a fresh start on life. He will be able to start a business and be in control of his destiny for the first time.”
While no amount can undo the physical and emotional impact our client experienced, this recovery provides the client with financial resources to help address his future medical care, ongoing needs, and the challenges he may continue to face.
