What Happens If My Condition Worsens After The Arbitrator Renders Their Decision Regarding My Workers’ Comp Claim?

You can seek additional benefits but only under certain conditions. If you did not accept a lump-sum settlement, the door may still be open to pursue further benefits. Under the Illinois Workers’ Compensation Act, you can request a review or modification of your original award if:

  • Your medical condition has significantly worsened since the Arbitrator’s decision

  • Your level of disability has increased beyond what was originally determined

To do this, you must file a Petition for Review or Modification with the Illinois Workers’ Compensation Commission (IWCC). This process allows your case to be reconsidered in light of new medical evidence but there are strict time limits, so acting promptly is essential.

What If You Accepted a Lump-Sum Settlement?

If your case was resolved through a lump-sum settlement, your ability to seek additional benefits is typically limited. Most lump-sum settlements include language that closes your case entirely, including your right to future medical treatment or compensation related to the injury.

However, there are exceptions. If your settlement agreement specifically preserves your right to future medical care, you may still be able to receive treatment for your worsening condition. This is why it’s so important to carefully review and negotiate settlement terms before agreeing to close your case.

Once finalized, most settlements cannot be reopened — even if your health declines or you face unexpected complications down the line.
