How Much is My Personal Injury Claim Worth?

The nature and severity of your injuries will typically be the most influential factor in determining the value of your personal injury claim. How your injuries impact your life and how long those impacts will linger will determine the types of damages you can seek and how much they will be worth.

Economic damages, or those with a specific economic value, include lost wages and expenses like medical bills or property damage. Your injuries can influence economic damages based on how much medical treatment they require, how long they prevent you from working, and whether they force you into lower-paying work.

You may also recover for your non-economic damages, compensating for the more subjective impacts on your life. Pain and suffering, scarring, loss of enjoyment of life, and emotional trauma are examples of non-economic damages that can arise from your injuries.

The nature of the accident can also affect how much a lawsuit is worth. The severity of the defendant’s behavior, the strength of the evidence, and their insurance policy limits can all play into the value of a claim. There are no strict legal limits on personal injury damages in Illinois. However, any applicable insurance policy limits can cap the amount you can recover. Insurance companies won’t agree to a settlement that exceeds their coverage limits.

Some policies contain separate limits for different types of exposure, allowing you to pursue additional damages even if some of your claims are capped.
